For the tl;dr people:


If you publish photos that were taken while trespassing, you are providing evidence of your trespass that can be used against you.

I wonder if posting on boards like this or uploading to Flickr counts as "publishing."

yes it does... You can go after someone for copyright infringement for taking your pictures and posting it on a web site...

Photos posted can't be used to arrest you for trespassing or else we'd all be in jail by now! I think it's all a grey area though, as having a photo doesn't necessarily mean you were there illegally. Pictures with people in them are a bit more risky, but I still don't really know how the law actually handles that.

They cannot be used to arrest you because they don't prove you took the photo or were on the scene. Also as long as someone was granted permission at any time, they could have taken the photos. Now putting yourself in said photo is a bad idea because it places you at the scene and I do know of cases where that came back to bite someone.

From my experiences, and I am not a lawyer (though I was told this by a compitent one), three things are required for them to make an arrest:
1 to Place you at the scene
2 an on or about date you were on the scene
3 a site owner or agent thereof to press charges

A photo without you in it illiminates 1 and 2. Even if you are in the photo 2 is still difficult. Remember the burden of proof is on them, so they can't just say "oh who else would have taken the picture!" They actually have to prove that it was you who took it.

Ok, but think about Digital Photos. 99.9% of the time I edit my photos in photoshop before posting them here (resize mainly) but some shots like those that I've put on deviant art I purposely preserve the data so it shows on that website. I'm talking about the EXIF data that's embedded in your pictures. When I resize my pictures in photoshop, the data saved only says it was created in photoshop, that's it. When your camera takes the picture however, it saves the exact date and time, all the settings, and most importantly, the serial number of the camera. If you were to post a photo straight from the camera (which many people here do, I know because I like to check the exif data to see the settings you used) that you took inside an abandoned building all the data is there. Technically, the owner could press charges based on an image he took off a site like this. If the camera was registered with the manufacturer (my bodies are) then a subpoena could force them to release the info associated with the serial number from the picture. They would now satisfy 1 2 and 3 and your only defense could be that someone else had your camera.
